Tuscany Tonight "Tuscany to You" Recipe Contest

Official Rules

NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING. VOID IN CA, TN, AND UT AND WHERE PROHIBITED BY LAW. Open only to legal residents of the 50 United States and the District of Columbia (excluding residents of California, Tennessee and Utah), who are 21 years of age or older at time of entry. Contest starts September 3, 2010 at 12:00:01 a.m. CT and ends December 31, 2010 at 11:59:59 p.m. CT ("Contest Period").

Visit tuscanytonight.com and follow the instructions to submit your best Italian entree recipe(s) ("Recipe"). All recipes must be readily preparable. Recipes must be in English. Provide the number of servings your recipe will make, and list of ingredients in order of use with exact U.S. measurements followed by complete preparation directions and any other information you believe is relevant. Entries must be received by the end of the Contest Period. No photocopies, facsimiles, computer generated or mechanical reproductions of entries will be accepted. You may enter as often as you wish, but each entry must contain a completely original recipe.

Tuscany Tonight (the "Sponsor"), and their affiliated companies and agencies, are not responsible for illegible, late, lost, damaged, misdirected, postage due or incomplete entries/mail or interrupted or unavailable network, server or other connections, miscommunications, failed telephone or computer hardware or software or telephone transmissions or technical failures, Internet Service Provider/network/web site accessibility or availability, garbled or jumbled transmissions or other errors of any kind, whether human, mechanical or electronic; including without limitation the incomplete, incorrect or inaccurate capture of entry information. Sponsor reserves the right, in its sole discretion to cancel or suspend the Contest, should fraud, virus, bugs or other causes beyond the control of Sponsor corrupt the administration, security or proper play of the Contest. Sponsor reserves the right, in their sole discretion; to disqualify any individual found tampering (or attempting to tamper) with the entry process, the website, or the Contest. Any attempt by an entrant to deliberately damage the website or undermine the legitimate operation of the Contest is in violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek remedies and damages from any such entrant to the fullest extent permitted by law, including criminal prosecution and disqualification from Contest. In case of dispute as to identity of entrant, entry will be declared made by the authorized account subscriber of the e-mail account, who must comply with these Official Rules. All entries become the sole property of the Sponsor and will not be returned.

Upon review and approval by Sponsor, recipes will be published on tuscanytonight.com for public viewing. Visitors to the website will be able to vote for their favorite recipe. The top 10 most popular recipes will be selected upon end of contest to be judged.

A qualified judge will review each recipe to determine the Grand Prize. Judging of the Grand Prize winners will be based upon the following criteria: (1) originality (40%), (2) simplicity (30%), and (3) depth of flavor (30%). The judges' decisions on all matters pertaining to Tuscany Tonight "Tuscany to You" Recipe Contest are final. In the event of a tie, tie breaker will be based upon the highest score in the first judging criteria, continuing thereafter to each judging criteria in order (#1-3), as needed, to break the tie.

Grand Prize

Prize includes a dinner cooked by an authentic Italian Chef in the winner's home for the winner and three guests. All supplies, including ingredients, non-alcoholic beverages and cooking equipment will be supplied by Sponsor. All other expenses not specifically mentioned herein are solely the winners' responsibility. No prize substitution or cash equivalent of prize allowed except at sole discretion of Sponsor due to unavailability of prize for any reason in which case a prize of equal or greater value will be awarded. Prizes are not transferable and will only be awarded within the United States. Limit one prize per household.

By accepting the sweepstakes prize, the prizewinner releases and forever discharges Folio Fine Wine Partners and its officers, board, and employees, jointly and severally from any and all actions, causes of actions, claims and demands for, upon or by reason of any damage, loss or injury, which hereafter may be sustained by participating in the sweepstakes prize activity.

Employees or officers, directors, agents of Tuscany Tonight, Folio Fine Wine Partners or their respective parent companies, affiliates, subsidiaries, advertising/promotional agencies, and members of the immediate family (parent, child, sibling or spouse) or persons living in the same household of such individuals, as well as employees of suppliers, distributors, licensees (including retailers) of alcoholic beverages are ineligible to participate or win a prize.

Submission of a recipe grants Sponsor and its agents the right to publish, use, adapt, edit and/or modify such recipe in any way, in any and all media, without limitation, and without consideration to the entrant. Submission of any recipe further constitutes the entrant's consent to irrevocably assign and transfer to the Sponsor any and all rights, title and interest in the recipe, including, without limitation, all copyrights. Entries: must be the original work of the entrant; may not have won previous awards; may not have been published previously; must not infringe third-party intellectual property or other rights, and must be suitable for publication (i.e., may not be obscene or indecent). By submitting a recipe, you agree that your submission is gratuitous and made without restriction, and will not place Sponsor under any obligation, that Sponsor is free to disclose or otherwise disclose the ideas contained in the recipe on a non-confidential basis to anyone or otherwise use the ideas without any additional compensation to you. You acknowledge that, by acceptance of your submission, Sponsor does not waive any rights to use similar or related ideas previously known to Sponsor, or developed by its employees, or obtained from sources other than you. By participating, entrants release Tuscany Tonight, Folio Fine Wine Partners, their respective parent companies, affiliates and subsidiaries and each of their respective directors, officers, agents and employees, from any and all liability with respect to participation in the Contest or to acceptance or use (or misuse) of any prize or to participating in any prize-related activities, including travel. Except where prohibited by law, by accepting prize, winner agrees to use of winner's name, address, city, likeness and any statements made by winner regarding the Contest or Sponsor (provided same are true), as well as the use of the Recipe, for advertising or publicity purposes worldwide without limitation and without compensation and further grants Sponsor any and all rights to said use. By entering, entrants agree that all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, participant's rights and obligations, or the rights and obligations of the Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of State of California, without giving effect to any choice of law or conflict of law rules. By entering, entrants consent to the jurisdiction and venue of the federal, state and local courts for Napa County, California.
